In 1796 with wife and two children, he moved to Ohio and settled in what is now Warren County, where he remained until after the death of Elizabeth. He then went to Montgomery County, Indiana to live with one of his children, where he remained until his death.

    George Harlan was a native of Chatham, North Carolina, a Quaker in religious belief, and a farmer by occupation. He removed to Ohio in 1796, locating first at Columbia, and in 1797 proceeded to Warren County, north of Lebanon, where he resided until his death, December 21, 1846. He was the first Sheriff of Warren County, and also served as County, Commissioner, Justice of the Peace, and Associate Judge of Common Pleas Court. He was a member of the General Assembly of Ohio from 1807 to 1809. His wife Hester (Eulass) was a native of Harrisburg, Virginia., in the Shenandoah Valley, and a daughter of Jacob Eulass, an early pioneer of what is now Scott County, Ky., settling there in 1787, of Holland descent. She died December 29, 1858, in her eighty-first year. The preceding facts are taken from an old family Bible, once the property of Judge Robert Harlan's grandfather, and handed down to the present generation. It was probably published about 1700.

    "April 14, 1829: ....yesterday George and I went to see Samuel and his family.
    "April 15, 1829: George and I went to see Aaron and family, and spent the day very agreeably with them."

    OBITUARY
    A fitting Tribute to the Memory of Judge Justin Harlan
    Justin Harlan, one of our oldest, most highly esteemed and most prominent citizens, died at the residence of his son-in-law, Mr. W. A. Wright, at Kuttawa, Kentucky, on Thursday morning the 13th inst. He left his home here, to make his daughter and son-in-law a visitor, but a few days since, with no symptoms of ill-health save a slight cold; and , after his arrival at Kuttawa, no alarming symptoms in regard to his health were discovered until within two or three days of his death. Even then, he protested that there was nothing the matter with him, and it was with great difficulty that his daughter could prevail upon him to go to bed. From the time he took to his bed, he gradually became weaker and weaker, until life ceased. He died, apparently without a pain. Death came to him as peacefully and sweetly as the sleep of an infant. It was a fitting close—such as, doubtless, he desired—to an honorable and well-spent life. Although absent from home, he was surrounded by friends, and everything was done for him that affection could desire or skill suggest.

    Mr. Harlan was born on his father’s farm, near Ridgeville, in Warren County, Ohio, on the 6th of December, 1800. having received a good common school education, on arriving at the age of manhood, he commenced the study of the law in the office of Hon. John McLean, who was shortly thereafter made Post-master General, and still later one of the Judges of the Supreme Court of the United States; but, in consequence of official engagements requiring McLean’s presence in Washington, Mr. Harlan’s preliminary legal studies were completed in the office of Judge Collett, an eminent jurist then residing in Warren County.

    In May 1825, Mr. Harlan settled at Darwin, then the county seat of this county, and, at once, engaged in the practice of his profession-traveling, as was the custom, with the Judge, from county to county, throughout the circuit. He was soon recognized as one of the ablest lawyers in the circuit, and obtained a practice which that reputation merited. But, even such a practice, at that day, monopolized only a small portion of time and brought but a small income; for there was little litigation in the country, and what there was, was not such as commanded large attorneys’ fees. There were but two terms of court in the year, and in but a single county in the circuit did the term last a week—in all the others it terminated at the end of from one to four days. Accordingly, in the intervals between terms of courts, Mr. Harlan had an abundance of leisure time—and this, for some time, he divided between assisting an elder brother, Jacob, (who held all the important county offices and that of village postmaster,) in the discharge of his official duties, and fishing and hunting, of which amusements he was always passionately fond.

    Within a few years after settling at Darwin, Mr. Harlan was elected a justice of the peace, and this office he held until he was elected a Circuit Judge.

    In 1832 he was married to an estimable lady, Miss Lucinda Hogue, the daughter of an old pioneer and highly respected citizen, and she still survives to mourn his death.

    During the sessions of the General Assembly, between 1828 and 1834, Mr. Harlan was several times elected to Clerk-ships connected with the current sessions.

    In the summer of 1832, he served a three months campaign in the “Blackhawk War,” as second lieutenant, in a company from this county of which John F. Richardson, long since deceased, was captain and the late Woodford Dulaney was First Lieutenant.

    The session of the General Assembly of 1884-‘5, re-organized the Judiciary, relieving the Supreme Judges from holding circuit courts as they had before that time been required, and elected five Circuit Judges. These were Richard M. Young, Stephen T. Logan, Sidney Breese, Justin Harland, Henry Eddy, and Thomas Ford. Harlan’s circuit was the 4th Chief Justice Wilson’s old circuit. He was commissioned January 9, 1835, and at once entered upon the discharge of the duties of his office. Eddy resigned his office in February 1835, and Alex F. Grant was immediately elected and commissioned in his place. His circuit was the third and included all of Southern Illinois, proper; Harlan’s circuit included Vermillion and White counties and all the intermediate territory. In the fall of 1835, Harland and Grant exchanged circuits, in order to afford opportunity for the trial of causes without change of venue, in which they had been concerned as lawyers—and thus Harlan, during his term, held Circuit Court in every county then organized, in full one-third of the entire Territory of the State.

    Of all the judges elected with him, the venerable Stephen T. Logan alone survives him.

    In 1837, Mr. Harlan removed to a farm which he had purchased, at the long since extinct town of Aurora, located at a point two and a half to three miles above Darwin, where the Wabash River making a curve to the westward touches the Illinois bluff. Here his family resided until in 1839, when he removed to this place were his home has ever since continued.

    The General Assembly, by the act of February 11, 1841, re-organizing the Judiciary, legislated the Circuit Judges out of office—Mr. Harlan included with the rest, and required the Circuit court to be held by the Judges of the Supreme Court. From this date until his election as Circuit Judge by the people, Mr. Harlan engaged actively in the practice of his profession, and is all cases not depending upon the efforts of advocacy alone, he was universally conceded to be without a superior among those who practiced at the bar of the circuit. In 1843, he was the nominee of the Whig party, in this district, for Congress-but his party being largely in the minority; the Democratic nominee, Mr. Ficklin, was elected.

    In 1847, Mr. Harlan was elected, conjointly with Dr. Tutt, delegate from this county—(the late Hon. Uri Manley being at the same time delegate from this senatorial district,) to the convention called to frame a new constitution for the State. In that body of able and distinguished men, he occupied a prominent position and he bore a conspicuous part and wielded a controlling influence throughout all its deliberations.

    In September 1848, Mr. Harlan was elected by the people Judge of the fourth Judicial Circuit—his competitors for that office being the late William Wilson, for near thirty years Chief Justice of the Supreme Court, and the late Hon. Charles II. Constable, afterwards his successor upon the circuit bench. In 1855, he was re-elected Circuit Judge. In 1862, he, for a brief time, resumed the practice of the law;--but, in 1862, upon receiving an appointment from his personal friend, President Lincoln, to an Indian agency, he abandoned his profession—and, since then, he was never attempted to engage actively in its practice. He performed the duties of Indian Agent until in 1865, when he returned to his home, and devoted his time chiefly to straightening up and setting in order his private affairs; until in 1873, when he was elected Judge of the County Court of this county. He held this office for one term. Since then, his time has been occupied in looking after his domestic affairs, in reading, and in the enjoyment of the society of his friends.

    Lawyers, competent to know, say that Mr. Harlan was, by, nature, a great lawyer. He had, in the maturity of his manhood, a memory that was almost marvelous. His mind was acutely analytical, and his sense of justice was almost unerring in discriminating the right from the wrong. He had a large heart, throbbing with charity and mercy for those who, by reason of weakness rather than from inherent wickedness, transgressed the law; but for those who boldly defied the law, and willfully preferred the wrong to the right, he was stern and inflexible in meting out the punishment demanded by the law.

    He was plain and simple in his dress, habits and tastes. He had but few wants, and they were of the simplest character and easily satisfied. He was without vanity, and associated on terms of intimacy with the humblest and the lowest, with as much apparent satisfaction as with those whom the accidents of fortune had more favored. He was imminently social, and always cheerful; and his presence frequently brought sunshine and cheerfulness, where that of others would have brought clouds and discontent. In his domestic relations, he was all that a good man should be. He was fond of little children, and as is always the case, they, in turn, were equally fond of him. Many a bright little eye will be blinded with tears, when it is known that is no more.

    Judge Robert Barclay Harlan, deceased, was born July 31, 1808, in Warren County, Ohio, and is the seventh of ten children whose parents were George and Hester (Eulass) Harlan. Robert worked on a farm until he was sixteen years of age, attending the winter district school. In 1828, he came to Wilmington and secured the position of Deputy to the County, Clerk, remaining in the office eight years, and reading law during his leisure hours. In 1837, he passed the requisite examination, and was admitted to practice at Chillicothe. He immediately entered upon his professional duties at Wilmington, where he resided till the time of his death. In early life, Judge Harlan's political views were strongly in sympathy with the Whig party; but in 1854 he became a charter member of the Republican party, and was a faithful and earnest champion of its principles through the remainder of life. In 1840-41, he represented Clinton County, in the Ohio Legislature, and again in 1850-51. In 1856, he was elected Judge of the Court of Common Pleas of the Second Judicial District, holding that office only one term, but being recognized as one of the ablest men ever occupying that position. Judge Harlan was Captain, Colonel and Major General successively of the Ohio Militia, under the old laws. During the Mexican war, he raised a company of volunteers, but upon the completion of the roster it was found that the quota was filled, and the company was therefore disbanded. When President Lincoln issued his memorable call for 75,000 men to crush the rising rebellion, Judge Harlan immediately went to work, raised a company of volunteers, and offered their services to the State, being the first company of men to respond to duty's call in Ohio. This body of men subsequently became Company B, of the Twelfth Ohio Volunteer Infantry, and afterward did good service in Ohio and Virginia. Judge Harlan raised another company which was equipped and sent to the field, but he remained in Wilmington. He was engaged in the practice of his profession, which was very large, and proportionately remunerative until his demise. His general health was excellent, although he had frequent momentary attacks of heart disease. Judge Harlan was an active, enterprising and valuable member of the Clinton County, Pioneer Association. On September 1, 1877, he was preparing a paper to be read at a meeting of that society, and while sitting on the porch attached to the east of his residence, he was suddenly taken with heart disease and passed away before help could be summoned. He was married in 1838, to Maria D., a daughter of Isaiah Morris, a native of Wilmington. Mrs. Harlan departed this life in 1843, leaving three children. One son died soon after, and on September 9, 1877, another son, Morris, also passed away. He was Vice United States Consul to Hong Kong, China, for seven years previous to his death, resigning his position and coming home on account of ill health. He was very sick at the time of his father's death, which no doubt hastened his own, as just eight days elapsed between the two. The other child -- Clara E., married D. H. Barley, formally United States Consul to Hong Kong, now a resident of Cincinnati. On March 10, 1848, Judge Harlan was united in marriage to Caroline E. Haworth. Four children were the fruits of this union; three daughters are living -- Lucy M., wife of Alfred Thorne, of Wilmington; Antoinette, wife of A. E. Clevenger, a prominent young attorney of Wilmington; and Gertrude, wife of Arther W. Eastman, of Mainville, Warren County, Ohio. George is deceased. Mrs. Harlan's parents were George D. and Edith (Hadley) Haworth. Her father was a native of Tennessee, who came to Ohio in 1804, locating two miles north of the present site of Wilmington. He was a prominent agriculturist of Clinton County, and for nearly a quarter of a century served its citizens as Treasurer. Mrs. Harlan's mother was a native of North Carolina, who came to Highland County, Ohio, in 1811, and a few years later to Clinton County,. Judge Harlan was a member of the Legislature when the bill was drafted to build the Cincinnati, Wilmington & Zanesville Railroad, now the Muskingum Valley Branch of the "Pan Handle" road, and by the exertion of his eminent legal powers, and the weighty influence he personally controlled, the charter was granted. Judge Harlan was a man respected by all the citizens of Clinton and adjoining counties. He was eminent for his legal attainments, and before a jury, though somewhat hesitating at the commencement of a speech, finally grew strong and argumentative, and rarely failed to win the case. Throughout his career at the bar, no client ever lost by his inattention to the merits of the case, his inability to present all the good points to the jury, or by his failing to consult all the authorities that sustained the case. He was recognized as the most noted counselor in Clinton County, and distinguished for simplicity of character, frankness and earnestness of purpose. In bushiness matters, he was austere and eccentric, firm but not domineering; and adhering with great tenacity to his own opinions. His originality of thought, coupled with his great knowledge of all local questions, gave him a hold on the people never equaled by any man in the county. His great love of pioneer history, and its reminiscences brought him into close communion with the aged and weary, and possessed his soul to such an extent as to lead him to write a large part of the interesting matter that forms our county history proper. No man in Clinton County, was better learned in its pioneer history, and no man could collect and compile reminiscent sketches in a better manner than the subject of this notice. Writing history was the sole labor of Judge Harlan in his latter days, and to the excellence of this work the people owe Judge Harlan a debt of gratitude only to be paid by due reverence to his memory. Socially Judge Harlan was quiet and unobtrusive. He was kind-hearted and benevolent when reached by a tale of suffering, an object of unquestionable charity, or a cause worthy of philanthropy. In the home circle, he demanded strict obedience of his children, and repaid them by meritorious acts of filial affection. Having been reared a Quaker, Judge Harlan accepted the views of that society, but was subsequently a Methodist, and in later years enjoyed the largest liberty of thought, "Love to God and love to men," being his doctrine. Few men have achieved such results, if compelled to attempt them with no outfit from school instructions beyond the little received from childhood, as was the case with him. While every man is self-made, Judge Harlan was one who made himself with fewer helps than most who have reached such positions as he filled and occupied. His career illustrates the advantages of specialty in labor, and the success which may follow an entire devotion to a single department of professional work. Free and upright in all his duties, he left a name truly honorable, and a character worthy of emulation. A learned friend has said: "Clinton County, never produced or developed a greater man that Judge Robert Barclay Harlan." [Source: Chicago: W. H.     We have had so far one of the mildest winters I ever recollect seeing, we have had but little snow, none more than about two inches deep, very little rain; the roads have been good, compared with other winters and I never recollect passing one more agreeably, my health has been good; and if it was not for my long seated rheumatism that prevents my stirring out, I should be one of the happiest old fellows that lives in any country; but that prevents me from stirring out; but gives me but little pain while I sit or lie still; but the moment I rise to my feet that moment the pain attacks me. I am well waited on as I have had two little boys of the name of Slade come stay with me alternately through the winter; and finer little fellows need not be wished for they take care of our small stock, keep them in first rate order and do everything that is required of them with perfect cheerfulness. Their father is a blacksmith; has bought an acre from Geo. Cornel at the corner next to Smith; has got his shop up and is at work. He is the man that brought Enos Lackey before the Church for willful and deliberate lying: on an investigation the charges were pointedly proven by as respectable members as any in the church; but of all the gaffes that I have ever laid my hands on in Criminal Jurisprudence I have met with; but only one that runs exactly parallel with the present; and that was the celebrated case of a blacksmith who was tried and found guilty of horse stealing. Where the Court averted the Judgment, on the ground that there was but one Blacksmith in the place, and as the people could not do without one, the Court very wisely ordered the sentence to be executed on a Drunken Irishman; as it was impalpable to satisfy Justice without hanging somebody; so in the case in which Enos was concerned; the preacher and the committee, after prayerful investigation and laying the whole affair before the Lord came to the very wise conclusion that it was expedient to spread the broad mantle of Charity over the whole affair, for if Charity could cover a multitude of sins it could easily cover one bit of a lie; especially as Enos was clapleader and has two farms, and lives almost at the door of the Church house; and in addition to that he enjoys religion and could easily be heard pray half a mile and was not ashamed or afraid to pray anywhere even on the housetop or at the corner of the Street; and as for Groaning he was not to be beat by anyone in the whole Ohio Conference; but best of all he was most able and willing to pay quarterage both for himself and a large family and for these substantial reasons he was honorably acquitted, and a boy of 14 was turned out in his stead as the boy was thought to have no religion; for some time last spring the report said that he had been heard to say an evil word not comporting with religion for he had said Durn a pig that had crept into the garden.

    You will no doubt be surprised when I tell you that notwithstanding the strong marks of wisdom, Justice and the expediency of the above decision there are some that think Enos ought to have been turned out of Church, others think that would have been too hard, as the Devil was more to blame, but that it would have been well enough to take his office from him and put him at the foot of the Clap, but the better informed think that it is best as it is, for if they were to turn all out who are sometimes under the necessity of telling a few lies for the sake of a trade, they would be obliged to lose some of their most pious members and some of their best and most zealous teachers.

    Mr. Enos Lackey, and his wife, Matilda, of this place, celebrated the 50th anniversary of their marriage, on Saturday the 8th inst. Quite a number of their children and grand-children were present, together with the Rev. D. Kemper, and wife, and the Rev. W. Young, and wife. After the quests had partook of a most sumptuous dinner, the Rev. W. Young, in behalf of the children, with a few remarks, presented the parents with some beautiful presents, the Rev. D. Kemper closing the interview with prayer. The occasion was a most pleasant one. Mr. Lackey is a native of this county, his wife was born in Butler county.     History / Bio:

    Enos Lackey, farmer; P. O. Lebanon; was born in Clear Creek Township, Warren County, Ohio, Oct. 21, 1802; he is the son of Richard and Sarah (Harlan) Lackey, the latter being a native of South Carolina; his father emigrated to Ohio in 1796, and settled in Clear Creek Township, where he remained until the breaking-out of the war of 1812, when he enlisted and soon afterward rendered up his life--a sacrifice to his country. Our subject received no other education than was afforded by the log schoolhouse and country schoolmaster of pioneer days. He has been a farmer from his earliest days until recently, when he retired from active labor; he commenced life by working out, and was soon enabled to rent a farm, after which he bought a small farm and continued adding to it until he owned 400 acres; he has amassed a comfortable competency, which he is fully enjoying in his advanced age. He was married, in 1823 to Martha Irvin, who was born in Hamilton County, Ohio, Sept. 9, 1806; her father was also a soldier in the war of 1812. They have had fourteen children, who were, at one time, all alive and married, but of whom only nine now survive. Mr. and Mrs. Lackey are both members of the Methodist Episcopal Church, in which he has for some time been an officer; they are both models of the honest, open-hearted and hospitable pioneer farmers, whose record for Christian integrity is above question.

    Mrs. Capt. H. H. Hamilton and son, Milo, of Chattanooga, Tenn., after a pleasant visit to Mr. Enos Lackey, father of the former, left Lebanon on Monday for Cincinnati where Milo will remain while his mother goes on to Indianapolis to visit relatives. They will return to their home in the South in a few weeks.

    —Mr Enos Lackey who was stricken with paralysis a few weeks ago, is still lying in a precarious condition at his home north of town. (p5)

    —Although it is considered a delicate, and sometimes dangerous thing for Courts to meddle with deeds, so far as to declare them utterly void, it nevertheless occasionally happens that a Judge is called upon to decide and declare whether instruments of this kind shall stand and operate to defeat the claims of honest creditors.
    —The second case wherein the validity of a deed has been called in question in our Common Pleas Court during the past few weeks was decided by Judge O'Neall last Monday.
    —The first was the Hunt case, in which Judge Doan sat, and the one now under consideration was the case of Wm F. Dill against Job and John Lackey. The trial of this case came off at the close of the last term of Court, but Judge O'Neall reserved his decision until the time named above.
    —Wm. F. Dill, the plaintiff, asked to have certain deeds set aside which were made to Job and John Lackey by Enos Lackey in his lifetime, and which the plaintiff alleged were false and fraudulent.
    —The interest which Mr. Dill had in this matter grew out of a promissory note which Enos Lackey endorsed and transferred to him for a valuable consideration. The note was for $3,000 and was jointly made by John S. and James A. Roseberry.
    —At the October term of Court, 1883, Wm. F. Dill recovered a judgment against the makers and endorser of the note for the sum of $1545 and the costs of the suit. no part of the judgment has ever been paid, and one of the Roseberrys has since died insolvent while the other is a non-resident of this county and also insolvent.
    —The pleadings allege that Enos Lackey conveyed, after the suit on the note was commenced, certain tracts of land to Job and John Lackey that should now be made subject to the payment of this claim, on the ground that the conveyances were fraudulent.
    —Judge O'Neall in a lengthy review of the whole case, in which he cites numerous authorities to back up his decision, declared the deeds null and void and set the same aside.
    —Touching the charge of fraud he had this to say:
    "But is has been argued that we can not set these conveyances aside upon the ground of fraud without impugning the Christian character of Enos Lackey, and reflecting upon his sons, John and Job Not so. Enos Lackey was, I believe, a Christian gentleman. I never heard his integrity questioned, we are not now questioning it, nor that of his sons. The act may be adjudged covinous, although the parties deny all intention of committing a fraud. It is not necessary to impute to the parties "A premeditated or wicked intention to destroy or injure the interests of others." A man may commit a fraud without believing it to be a fraud. From the testimony before us, including the papers in the case of Dill Vs. Roseberry et al., it is evident that Enos Lackey believed that he had been relieved from all liability to plaintiff; he doubtless felt and believed that plaintiff had extended the time of payment of said note, thereby relieving him from liability. He did not feel morally bound to pay it; he believed that the plaintiff was the wrong-doer; he believed that he had a right to prefer his children, his sons. Thes defendants shared his feelings, they felt that they were doing no moral wrong in accepting the deeds.
    —The following were the last words of his decision:
    —I shall not say that the transfers were voluntary or fraudulent, but simply void as to the creditors of Enos Lackey. I do not attribute moral fraud, but pronounce the transactions fictitious. Looking at the probable views of the parties at the time these transfers were made, there appears to be no moral turpitude in it. I do not mean to even insinuate that there was any moral turpitude on the part of the Lackeys. I do not believe there was any. Yet I cannot believe that either law or equity can uphold these conveyances. Thse deeds are therefore held and declared to be void, and are set aside and held for naught.

    Obituary:

    Death of Enos Lackey.
    Again we are called upon to chronicle the death of another pioneer. Enos Lackey died at his residence on Broadway last night in the eighty-second year of his age. He was born in Clearcreek township, October 21, 1802, and has lived in this county all his life. Until a few years ago he resided on a farm north of town on the Dayton pike. During the past winter his health has been gradually failing and he was confined to his room most of the time.
